Are you a home seller considering listing your property "as is"? Here's what you need to know:

  1. Seller Conditions: A seller has the prerogative to set conditions on accepting offers. They can for instance request that their agent list the property will be sold "as is" and indicate this in the Residential Contract.

  2. Inspection Refusals: While a seller can refuse to allow inspections or the termination option, this is generally inadvisable. Preventing inspections can increase the risk of legal claims for withholding property condition information. And, most buyers are hesitant to purchase a home they cannot inspect.

  3. Inspection Rights: Allowing inspections does not obligate the seller to make repairs. It merely provides transparency and peace of mind for buyers.

  4. Legal Counsel: It’s crucial for sellers to consult with an attorney when making significant contract changes. Real estate agents aren't lawyers while they can work with promulgated forms approved by their state governing body (in Texas this is TREC), they cannot draft legal provisions.

  5. Professional Best Practice: As a real estate agent, I discuss these points with my clients and recommend consulting an attorney should they wish to place restrictive conditions within the contract.
